Picture/Video Upload Agreement:
Thank you for your Photo(s)/Video(s) (“Material”) submission to “Sherri” (the “Series”). Due to the large volume of media we receive, we cannot guarantee that your Material will be shown on the Series. But, be on the lookout because a ‘Sherri’ producer may be contacting you about your submission.
We respect other people’s rights and expect you to do the same.
This means that you cannot submit Material on behalf of your brother, your best friend, your boss, your cute two year-old niece or anyone else unless that person or, in the case of your niece, her parent’s or guardian, gives you express permission and consent to submit his or her photo. In other words, you took the photo or video or someone took it of you at your request. This also means that you cannot divulge private information (i.e. addresses, email addresses, license plates, medical conditions, etc.) or facts about another person (living or deceased) without his/her consent. Nor shall your content bully, spread rumors or defame another. In other words, respect other’s business and do not make it our business.
This also means that your submission will not violate the intellectual property rights of another. It should not contain any trademarks, logos or trade dress owned by others, or advertise or promote or disparage or denigrate any brand or product of any kind. It also should not contain any artwork, music, photos or videos owned by another.
If anyone other than you are in the Material submitted, please include his/her name and, if a minor, the minor’s date of birth and your legal relationship (i.e. Mother, guardian), and provide a daytime telephone number where you may be reached.
Keep the Material and content daytime friendly
No sexually explicit, indecent, obscene, violent, hateful, harassing, abusive, tortuous, defamatory, slanderous or libelous content.
No material which is derogatory or promotes bigoted, racist, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
No references to tobacco, drug paraphernalia, firearms, or any description or representation thereof.
No content that is a) is unlawful, (b) would give or threaten to give rise to criminal or civil liability; (c) encourages conduct that constitutes a criminal offense; (d) encourages or provides instructional information about illegal activities; or (e) encourages acts of violence or dangerous stunts/behavior.
We respect your rights and appreciate the Materials you have submitted.
By submitting the Material, you warrant (1) that you have the written consent, release, and/or permission to use the likeness of each and every identifiable person in the Material in the Series, the Website or otherwise, (2) the Material does not violate the right of privacy or publicity of, or constitute a defamation against, any person or entity, and (3) that the Material will not infringe upon or violate the copyright or common law rights or any other rights of any person or entity.
When you upload or otherwise submit Material to the Series, you (1) grant an irrevocable license to Talk WW Production, Inc., and its owners, partners, principals, agents, employees, licensees, affiliated and related companies (hereinafter collectively “Producer”) to use the Material, and to use applicant’s name in connection with the Series, in any way, in any medium, worldwide, in perpetuity, (2) release Producer from any and all claims, damages, and/or expenses arising out of use of the Submission, and (3) agree to indemnify Producer for all claims, damages and/or expenses (including reasonable attorneys’ fees) arising out of any breach of the warranties or grants made herein.
